LUSAKA High Court judge Florence Lengalenga has granted former Kasama Central member of Parliament (MP) Geoffrey Mwamba leave to commence judicial review against Speaker of the National Assembly Patrick Matibini’s decision to declare his seat vacant.
“It is hereby ordered that the application be allowed and that the said applicant is granted leave to issue a notice for judicial review,” Mrs Justice Lengalenga’s order reads in part.

According to an application for leave to commence judicial review, Mr Mwamba, through his lawyers, argues that Dr Matibini’s ruling exercised judicial functions by interpreting article 71 (2) (c ) is a total disregard of the provision of 72 (1) (A) and the cases that are still active before the High Court.
On July 28, 2015, Dr Matibini declared the Kasama Central parliamentary seat vacant on account that Mr Mwamba had accepted the position of United Party for National Development vice-president for administration while being a member of the Patriotic Front.
