Chinsali man jailed for assault

A Chinsali man has been convicted and sentenced to 18 months imprisonment with hard labour for assaulting an elderly man on allegations that he had carnal knowledge of a mentally retarded girl.


Appearing before Magistrate Shedrick Chanda yesterday was a peasant farmer Paul Chanda ,37, of Senga village charged with one count of assault occasioning actual bodily harm contrary to the penal code 248 Chapters 87 of the Laws of Zambia.


Particulars of the offence are that on December 25, 2013, in Chinsali district in Muchinga province Michael Mubanga was assault thereby occasioning him actual bodily harm.


In passing judgment, Magistrate Chanda said the convict had no right to beat an old man like Mubanga with a cooking stick inflicting him with a deep cut adding that the best way the convict would have done was to report the matter to the police looking at the seriousness of
the allegations.


Magistrate Chanda further said the convict’s actions of getting physical only made the situation worse and landed him into more trouble saying that it is the duty of the courts to protect the elderly.

 

And, in mitigation, Chanda pleaded for maximum leniency from the court and that he was remorseful for what he did.


Magistrate Chanda however, said he had heard all that Chanda had said in his mitigation, the court had found him guilty upon his own admission of guilt and gave him a custodial sentence.


He said he was sentencing the accused to 18 months imprisonment with hard labour.
