Ndola defiler caged for 18 years

Ndola, Feb 20/13 ZANIS——-A 45-year- old man of Mufurila has been sentenced to 18years imprison with hard labour for defiling a girl under 16 years contrary to Section 138 [1] of the Penal Code Chapter 87 of the Laws of Zambia.

Before Ndola High Court Judge Mary Mulanda was Cephus Kambani who pleaded guilty to the charge.

Particulars of the offence were that on November 5, 2012, between 10:00hrs and 11:00hrs, Kambani defiled a girl aged ten in her parents’ house knowing that her parents were not around.

Kambani was caught in the act by Evans Mutale and his wife who were tipped off by a boy as they were going to the gardens.

Kambani managed to escape and the girl was taken to the chairperson, Mary Chisenga, who later reported the matter to Kawama police post.

Kambani was apprehended the same day around 21:00 hrs and later appeared before Mufurila magistrate’s court where he was convicted before the matter was referred to Ndola high court for sentencing.

After cross examination Judge Mulanda also found him guilty of the charge and sentenced him to 18 years imprisonment with hard labour.

In the same court, Judge Mulanda sentenced a 26-year- old Mufurila based taxi driver to 15 years imprisonment with hard labour for rape contrary to the Laws of Zambia.

This was in a case were Nicholas Malichanga from Mufurila was accused of raping Kashiwa Chewe in the back seat of his car on January 2, 2012.

In defence, Malichanga said Chewe was his girlfriend and that they had earlier met three times before the material day.

After cross examination the court found Malichanga guilty of rape and sentenced him to 15 years in prison with hard labour.
