A MAN of Kazungula who is charged with defilement of a 14-year-old girl has told the Livingstone Magistrate’s Court that he knew the girl was underage but claims the act was consensual.

Lawrence Sileke demonstrated before Livingstone magistrate Andrew Kasongo how he took off his clothes and put on a condom before he had carnal knowledge of the girl.

This is in a case where Sileke, of an unknown age, unemployed and a resident of Makalanguzu in Kazungula, is charged with defilement.
It is alleged that on dates unknown between January 1 and May 30, this year, in Kazungula, Sileke had unlawful carnal knowledge of a girl under the age of 16.

When the matter came up for plea, before Livingstone magistrate Andrew Kasongo, Sileke told the court that he had proposed love to the complainant and she accepted him.
“I don’t know how old i am because I don’t know when I was born and my mother equally does not know,” he told the court.
When asked by the court how he had sex with the girl, Sileke said he took off his clothes and wore a “rubber”.

But when told by the court to speak in clear language, Sileke was at pains to say that he dressed his manhood with a condom and then penetrated into the minor’s private part.
“Yes, your worship, I had sex with her, I undressed and I then put my condom on my manhood…, that is what is called sex,” he said.
The court reminded Sileke that he was not insulting by calling a body part by its name.

“Your worship, I don’t want to insult in court, I admit that I had sex with the girl,” he said.
Sileke also said that he was aware of the girl’s age because she had told him that she was 14.
“I met the girl at a bar, where I proposed love and suggested that we should have sex, and she consented to the act,” Sileke said.
The matter has been adjourned to June 30 this year for facts.
