A POLICE inspector has told the Choma Magistrate’s Court that an 11-year-old girl informed him that her biological father allegedly had sex with her on three occasions.
In this case, Francis Machaliso, 45, of Kamunza in Choma is charged with incest.
It is alleged that Machaliso, between February 1 and August 20, last year, in Choma, had carnal knowledge of a girl knowing the same to be his daughter.
The matter came up before chief resident magistrate Willie Sinyangwe for continued trial.
Testifying in the matter, Humphrey Chongo told the court that he was on duty at Choma Central Police on August 22 when he received a report from one Bizwell Sialwiinda alleging that Machaliso had carnal knowledge of his daughter.
Acting on the report, Mr Chongo opened a docket of incest against Machaliso, who at the time was within the premises of the police station as he had been apprehended by members of the community.
“I interviewed him (Machaliso) in connection with the allegations (incest) but he denied having carnal knowledge of his daughter,” he said.
Mr Chongo said he then interviewed the girl and she confirmed that her father allegedly had sex with her on three separate occasions.
The court heard that the police officer then issued a medical report form to allow the child to be examined at a medical facility.
Mr Chongo said medical examination results revealed that the girl had been defiled.
During cross-examination, the accused asked Mr Chongo if it was normal for him (Machaliso) to have sex with his own daughter, when it was forbidden by law. “I’m equally wondering why you did it,” Mr Chongo responded.
At this point, public prosecutor Coilard Sikwalulwa informed the court that the victim, who previously failed to testify, needed to undergo further counselling.
The case was adjourned to June 26 this year.
