ON AN ALLEGED COMPLAINT TO THE MAGISTRATE
9TH DECEMBER 2014
I have called a Press Conference today to share a matter of grave concern
I have learnt that a complaint was filed in the Lusaka Magistrate court using my names and details.
In this complaint, a matter is raised that allege that facts disclosed by Hon. Edgar Lungu, and Jean Kapata in their affidavits to the High Court, amounted to a criminal offence and the Magistrate was being requested to institute criminal proceedings against the duo.
This is in

a matter where Hon. Newton Nguni is contesting the alleged irregular manner in which the hand-over of the Presidency was done on 29th October 2014 following the death of President Michael Sata.
Critical to this matter are the facts before court that purport that I, Austin Katuta had sworn and filed the complaint against the duo before the Lusaka Magistrate Court.

WHY HAS MY NAME BEEN DRAGGED INTO THIS?

I was at the University with Emmanuel Bwalya Sampa (EBS) now known as Miles Sampa.
Last week, PF Matero Constituency Chairperson Morgan Ng’ona called me to get my personal details and stated that they needed my details for something that would be discussed or disclosed later.
That was the last I heard from him.
Then on Saturday, I discovered through The Post of Saturday 6th December 2014 and Sunday 7th December 2014 that a complaint had been laid to the Lusaka Magistrate Court about this matter. The Report showed that I had raised the complaint to the Court.
I wish to clearly and categorically, state that I didn’t complain about this matter, I did not lay any complaint to the Lusaka Magistrate Court; I didn’t sign any affidavit, I did not give any consent for anyone to use my name.
Clearly, this is a serious case of forgery.
I am therefore surprised that a complaint was raised in my name. This matter is so serious that anyone that has done this has committed serious offences.

It is for this reason that I wish to proceed to make a formal complaint to the Police. I find the use of my name without my express authority by way of signing to be a very serious criminal offence and I take strong exception. From my little legal knowledge it is clear that the following offences have been committed:

1. Uttering false documents
2. Forgery and falsely uttering my signatures
3. Perjury to court

Whoever laid this complaint using my name has forged documents, signatures and has lied to court.
I therefore call upon the Police to investigate the matter.
