AMSTERDAM (Reuters) – The prosecutor of the International Criminal Court has asked for the trial of Kenyan President Uhuru Kenyatta to be adjourned indefinitely because the Kenyan government’s refusal to cooperate means she lacks evidence.

In a court filing seen by Reuters, ICC prosecutor Fatou Bensouda said she did not have enough evidence to prosecute Kenyatta, who is accused of stoking a wave of lethal inter-ethnic violence after Kenya’s elections in 2007, when more than 1,000 people were killed.

She said it would be “inappropriate” to withdraw the charges in light of Kenya’s “continuing failure to cooperate with the Court’s requests for assistance in this case”. Instead she asked judges to adjourn the case until Kenya began cooperating.
