Two Nakonde brothers convicted

Nakonde, May 31, 2013, ZANIS… The Nakonde magistrate court has convicted and sentenced two brothers to two years imprisonment with hard labour for being found in possession of a gun without lawful authority contrary to the laws of Zambia.

Appearing before Nakonde magistrate Joshua Sikazwe for judgment yesterday were  Luckson Siwale 37, and Arnold Siwale 22, both of Sanyanta village in chieftainess  Nawaitwika area in Nakonde district.

The duo were jointly charged with one count of being in possession of a homemade Muzzle loader gun without a firearm license contrary to section 10 (1) (2) (a) of the Firearm Act, Chapter 110 of the laws of Zambia.

Facts presented before court were that on February 23, this year the two brother s were arrested by police after they found them in possession of the gun at their home.

Both accused persons pleaded guilty to the charge.

When passing judgment the magistrate said upon the accused persons’own admission, he found them guilty and that he was going to convict them accordingly.

The magistrate said he had taken into consideration all what the accused had said but that such cases were so serious in the country hence the need to punish them in order to deter would be offenders.

He said he was therefore sending the two brother s to prison for two years with hard labor with effect from the day of arrest.

In mitigation both brothers said that they were sorry for what they did and were therefore asking the  court to exercise maximum leniency.
