Uncle jailed for defiling niece (8)

THE Kabwe High Court has sentenced a 44-year-old man of Serenje to 19 years imprisonment with hard labour for defiling his eight-year-old niece.

The same court also sentenced a 53-year-old man of Kabwe to 15 years imprisonment with hard labour for raping a 16-year-old girl who had gone to his house to ask for a part-time job.

Kabwe High Court Judge-in-Charge Eddie Sikazwe said it was saddening that a man who was supposed to protect his niece acted in such a manner.

Mr Justice Sikazwe said he was sending Mostern Chibuye to prison for him to reflect on his action.

This is in a case in which Chibuye was alleged to have defiled the girl on unknown dates but in June 2011 while her parents were away.

During trial, the girl, a grade two, testified that upon her return from school she found that her parents were away.

She said her uncle pinned her to the ground and defiled her while threatening to kill her if she revealed what had happened to her mother.

Mr Justice Sikazwe said it was shameful for Chibuye to “jump” on a small girl when there were many women roaming the streets.

Earlier in mitigation through his lawyer Kamo Simfukwe, the accused pleaded for lenience saying he had learnt his lessons during the time he had spent in prison.

In the rape case, Mr Justice Sikazwe in his judgment said it was people like Abraham Kalunga who were destroying society and that they deserved to be jailed

for their action.

Particulars of the offence are that Kalunga on September 24, 2011 did rape the girl who had gone to ask for a job.

Mr Justice Sikazwe sentenced Kalunga to 15 years in prison with hard labour.

Meanwhile, Mr Justice Sikazwe sentenced a 33-year-old man of Chibombo to five years imprisonment with hard labour for unlawful possession of Government trophy.
