A RUFUNSA resident has appeared in the Luangwa Subordinate Court for allegedly raping a 71-year-old woman.

Facts before magistrate Kabili Keegan Litia were that on December 23, 2015, Daniel Katowa, 35 of Shikakota village in chief Mphanshya’s area raped a woman of the same village as she was returning home from a tavern around 18:00 hours.

The victim told court that around 17:00 hours, she left Paulo tavern, where she went drinking and on her way home, she felt someone trip her and she fell down, and the “boy”, whom she recognised as Daniel, was on top of her, ripping off her underwear.

She said that she could not scream during the ordeal as Daniel held her by the throat to prevent her from doing so.

And the victim’s daughter told the court that she found Daniel having carnal knowledge of her mother on a footpath leading to their home.

She said on the material day, she had left home around 14:00 hours for Chimusanya market to have her hair done in preparation for Christmas Day and she returned around 17:00 hours.

She said when she arrived at Paulo tavern, she was told that her mother had just left for home and decided to follow her as she was worried about the baby that she had left in her mother’s care.

The daughter told court that on her way home, she found people lying near the footpath and on getting closer, discovered that it was her mother on the ground, bleeding from the mouth and nose, and there was a man on top of her.

She told the court that she grabbed the man, whom she later came to know as Daniel, pulled him off her mother and started shouting for help.

She said Daniel managed to free himself and run away.

After hearing from the victim and the three witnesses brought before the court, magistrate Litia adjourned the case to February 3.
