CHINSALI senior resident Magistrate Francis Nsokolo has sent a 49-year-old man to jail for 24 months with hard labour for assaulting his wife.

The court jailed Charles Mushili, a bricklayer of Ilondola village who was facing one count of assault.
On October 2, this year, in Chinsali, Mushili assaulted his wife Justinah Chanda, causing her actual bodily harm.
According to the facts presented, Mushili approached Chanda and started beating her for no apparent reason and that she bled through the nose and sustained a swollen right eye during the fight.
The matter was later reported to Prospect Police Station where the complainant was issued with a medical report.
In mitigation, Mushili told the court that he is a first offender and is married with one child under his care.

 

“I am asking the court to exercise leniency on me, I will not repeat the mistake,” Mushili said.
In passing judgment, Magistrate Nsokolo said the court had considered his mitigation of being a first offender who had pleaded guilty to the charge without wasting the court’s time.
“These cases of gender-based violence are on the increase and it is the court’s mandate to punish the perpetrators so that it serves as a lesson to would-be offenders,” he said.
Magistrate Nsokolo said the court had found Mushili guilty and that he will serve 24 months in prison with hard labour effective from October 7, 2015 upon his own admission of facts.
He said Mushili had no right to do what he did.
