THE Kitwe magistrate’s court has convicted a 19-year-old man of Kitwe and committed him to the High Court for sentencing for defiling a five-year-old girl.
Magistrate Kampinda Chipamu committed Marriot Mupenda to the High Court after he was found guilty and convicted of defilement.
Mupenda of house number 4117 Chamboli is alleged to have had carnal knowledge of a girl under the age of 16 on November 28 last year.
“It is not in dispute that the girl was defiled and there is no evidence on record suggesting that someone else took the girl from the wheelbarrow, I have no doubt that the state has managed to prove a case against you. I find you guilty as the charged and I convict you accordingly.
During trial, the minor testified that on the material day around 17:00 hours, she went with her aunt to fetch water.
She told the court that her aunt left her besides the road and whilst on the wheelbarrow, Mupenda came and told her that her parents wanted her and that he will buy her biscuits.
The court heard that Mupenda took the girl to the bush were he made her lie on the ground and pulled down his trousers off up to the knees.
The girl told the court that Mupenda defiled her and that she felt a lot of pain.
She testified that Mupenda then carried her on his back and that whilst on their way, they met her parents who asked Mupenda where he took the girl but that he did not say anything but instead he fled.
Later, Mupenda was taken to the police were he was charged and arrested for defiling a child.
