Court convicts step daughter defiler

Chisamba, July 25, 2014, ZANIS– A 39 year – old man of Chisamba has being convicted by the Magistrate court for defiling his 14 year – old step daughter.

The self-confessed defiler has however been committed to the Kabwe High Court for sentencing.

Facts of the offence are that Raphael Hamutinta on a date not known but between 1st January 2013 and 30th April 2014 had unlawful canal knowledge of his step daughter.

It was alleged that Mr Hamutinta sneaked into his step – daughter’s bedroom where she was sleeping and forced himself on her under the pretext that he had sought permission from the girl’s mother.

The court heard that girl resisted his step father’s sexual acts and reported him to the mother who did not take action.

It was alleged that the accused made it a habit and continued having canal knowledge with the girl.

The girl fled from the home to her cousin’s place where she reported the matter and the cousin in turn reported it to the committee of elders.

It was testified that Mr Hamutinta was called to the elders meeting where he admitted having had canal knowledge with his step daughter on three different times and the matter was then reported to Chisamba Police.

A medical report obtained from Liteta district hospital and presented in court proved that the girl had been defiled.

And in his testimony, Mr Hamutinta admitted having had canal knowledge with his step daughter with full knowledge that she was below the age of 16.

And Chisamba Magistrate Bartholomew Kaonga found Mr Hamutinta guilty of defilement but committed the case to Kabwe high court for sentencing.

Meanwhile, trial in a case in which a Teacher of Chisamba Primary school (Jacob Botha) 36  is alleged to have sodomized a twenty –two year old man (Jackson Lungu) of Chawama compound of Chisamba district has been adjourned to 30th July, 2014.

This is because the case has being allocated to a new prosecutor.
