A MAN of Kasumbalesa, who took advantage of his sister’s hospitality and defiled his seven-year-old niece, has been jailed for 40 years.
Kitwe High Court judge Isaac Kamwendo sent to jail George Musonda, 40, a bricklayer of house number 34 Minestone in Kasumbalesa in Chililabombwe when the matter was referred to the court for sentencing.
In passing the sentence, Mr Justice Kamwendo said he had considered the age of the girl and, therefore, a higher sentence was necessary to protect young girls from such crimes.
Musonda was charged with two counts of defilement and assault after he had carnal knowledge of the girl on September 4, 2012.
He later assaulted the victim’s father who was trying to apprehend him.
In giving testimony, the girl’s mother told the court that Musonda was visiting another family but on the material day, he insisted that he wanted to spend the night at their home.
She told the court that her two children were then directed to sleep on the floor and leave the sofa to the visitor.
The court heard that around 23:00 hours, the victim’s mother was awakened by her daughter who was crying and entered her room with clothes in her hands
She told the court that when she inquired why she was crying, the girl narrated what Musonda had done to her.
She narrated that it was at that point that she checked the girl’s private parts and observed that she was bruised and swollen.
When Musonda was confronted, he picked an object and hit the girl’s father, causing injuries on him.
In mitigation, Musonda said he was a first offender who deserved lenience, and that he regretted his action.
