Defilement case of a minor fails to take off, yet again

Trial in the matter in which a 28 year old man of Mtendere compound who allegedly defiled a minor failed to take off today . This is because witnesses in the matter were not available before the court.  Kapenda Kasoka who appeared before Lusaka Magistrate Albert Mwaba stood charged with defilement contrary to section 138(1) of Penal Code Chapter 87 as read with Act no. 15 of 2005 of the Laws of Zambia. It is alleged that the accused person on December  2, 2013 had unlawful canal knowledge  of a girl under the age of 16 years. When the matter came up for trial, the state informed the court that the witnesses in the matter were not present in court. The State also informed the court it was therefore applying for an adjournment. And Magistrate Mwaba expressed concern that the matter had been adjourned many times due to the same reason. Magistrate Mwaba told the State to ensure that the witnesses were issued with summons. The matter has since been adjourned to April 10, 2014 for trial and the accused person ‘s bond has been extended.
