The Constitutional Court has thrown out an application by the UPND to have the ballot papers and all election materials used in the August 11 elections be preserved and be in the custody of the court.

The Court threw out the application on the grounds that the UPND has no evidence that the ECZ might temper with the election materials.

UPND leader Hakainde Hichilema through his lawyers had filed an interim injunction seeking an order that pending the determination of the petition, ballot papers and all other documentation used in the August 11, 2016 be in the custody of the court.‎‎

Mr. Hichilema wanted the court to restrain the ECZ and its agents from altering, destroying, tampering with or in any way dealing with documents and materials pending the final determination of the petition.‎

Meanwhile the court will tomorrow make a determination on whether the 14 days for hearing the petition elapses tomorrow
