A 43-YEAR-OLD woman has told the Chingola Magistrate’s Court that her husband battered her after she greeted a man he suspected was having an affair with her.

Dorothy Matafwali testified before magistrate Shadreck Chanda on Tuesday that as they were coming from the market, she greeted a man and this infuriated her husband, Richard Muya.
She testifies that Muya, who could not wait to reach home to question her, started beating her on their way home.

Ms Matafwali was giving evidence against Muya, 44, of Kansoka area in Chingola, who is charged with assault.

He is alleged to have assaulted Matafwali on July 26, occasioning her actual bodily harm.
Ms Matafwali told the court that they are only two months into their marriage, and that her husband gets jealous when other men greet her.

“We were coming from the market going back home and when we reached Mushishima River, he started asking me about a man who had greeted me. I told him that I knew many people because I grew up in the area.

“He then told me that ‘I will kill you because you are cheating on me’.
“He started hitting me with a stick all over my body and I fell down. He then called me and we went home,” Ms Matafwali said.

She further told the court that the following morning, when her husband realised that she was severely swollen, he ran away from home.
In cross examination, Muya asked his wife if the two did not vow that that none of them should engage into an extra marital affair, and she answered in the affirmative.
Muya also asked Ms Matafwali if she was not beaten by her “demons” for cheating on him, but she responded that it was he who had beaten her.

“Didn’t the ‘spirits’ beat you because you are having an affair outside marriage,” Muya questioned his wife.
But the court found Muya with a case to answer and put him on defence.
“I have found you with a case to answer as a lot has been said against you. There is sufficient evidence against you. I therefore put you on your defence,” Mr Chanda said.
The matter has been adjourned to September 15th.
