Arson suspect committed to high court

 

Chinsali, 25 November, 2014, ZANIS…The Chinsali subordinate court in Muchinga province has committed a 23 year old man of Shiwang’andu to the High Court for sentencing on charges of arson.

 

 Appearing before Magistrate Shadrick Chanda today was Victor Chewe, 23,of Musowa village in Shiwang’andu district of Muchinga province charged with one count of Arson contrary to section 328 (a) of chapter 87 of the Laws of Zambia as read with Act number 17 of 2007.

 

 It is alleged that Chewe on 30 September 2014 wilfully and unlawfully did set fire to the dwelling house of Emeldah Kaluba destroying property valued at K1, 155.

 

Items destroyed in the fire included house hold goods and K500 cash money but Chewe denied the charge.

 

The victim told the court that she has a child with the accused person but that they separated adding that she is now married to another man.

 

She further told the court that she spotted Chewe near her dwelling place on the material day before the house was set ablaze.

 

The court also heard that the accused pleaded for forgiveness from the victim and promised to replace the roof when the Community Crime Prevention Unity (CCPU) members went to apprehend him.

 

Magistrate Chanda said the court had found Chewe guilty as charged and therefore committed him to the high court for sentencing during its next sitting owing to the nature of the case.

 

The case attracts a maximum sentence of 10 years in accordance with section 217 of CAP 88 of the Laws of Zambia.
