Samfya man 25 convicted to one year for obstructing, diverting electricity

Samfya, September 11, 2014 ZANIS— A Samfya Magistrate Court has sentenced a 25 year old man to 12 months imprisonment with hard labour for fraudulent appropriation of power contrary to section 290 of the Penal Code Chapter 87 of the laws of Zambia.


Before Magistrate Mambwe Kanunka was Fredrick Mwewa of Malombola Village in Chief Kasomabangweulu’s Chiefdom in Samfya District Luapula Province.


Mwewa was arrested by ZESCO security officers on May 3, 2014 during a door to door inspection in Mwamfuli village.


Facts before the Court were that Mwewa between  March 1, 2013 and 3 May 3, 2014 in Samfya jointly and whilst acting together with other persons unknown did obstruct and diverted electricity power by way of illegal by-passing a ZESCO prepaid meter number 4244547 to the use of his welding machine at Mwamfuli village.


Mwewa is believed to have been renting a shop at Tusungane Orphanage Centre, where he did the illegal by-pass and used electricity power property of ZESCO Limited for five days.


In mitigation Mwewa pleaded for lenience saying he was a bread winner who was looking after his two young sisters and his disabled uncle.


But in passing judgment, Magistrate Kanunka said she was lenient on the accused by sentencing him to 12 months imprisonment with hard labour when the offence in question carries the maximum of 10 years and above for a first offender.
