Mulusa threatens to sue Speaker of the National Assembly Patrick Matibini

FORMER Solwezi Central MMD member of Parliament (MP) Lucky Mulusa says he will sue Speaker of the National Assembly Patrick Matibini for allegedly failing to discharge his duties.

Mr Mulusa said Dr Matibini has allegedly failed to sanction the Director of Public Prosecutions (DPP) Mutembo Nchito whom he accused of lying to a parliamentary select committee.
“Our Constitution allows any citizen to sue a government official for failing to discharge their duties,” Mr Mulusa said at a press briefing in Lusaka yesterday.
He said he would use writ of mandamus to take court action against the Speaker.
“The Speaker has neglected to respond to my polite request to sanction Mutembo Nchito for [allegedly] lying to the parliamentary select committee where I was chair when I was MP,” he said
Asked why he allowed the ratification of Mr Nchito as DPP when he was chairperson of the parliamentary select committee, Mr Mulusa said at the time, Mr Nchito fulfilled all the legal provisions.
And Mr Mulusa said President Sata should have considered appointing an elected minister to act as President instead of Mr Wynter Kabimba who is a nominated MP.
“While it is constitutionally right to appoint any Cabinet minister to act as President, Mr Sata should have considered an elected minister,” Mr Mulusa said.
Efforts to get a comment from acting Minister of Information Mwansa Kapeya proved futile as his mobile phone went unanswered on five attempts.

    • Yes one expects to lose the war thus suing government just becomes academic! It tells a lot about our governance systems where the Executive arm is taken to be above Judiciary and Legislative arms
