NEW legislation passed to enhance accountability in the public management of funds

The five pieces of legislation include the Competition and Consumer Protection Amendment Bill, the Environmental Management Amendment Bill, the Fees and Fines Amendment, the Patents and Companies Registration Agency Amendment Bill, and the Weights and Measures Amendment Bills.

Presenting the Competition and Consumer Protection Amendment and the Environmental Management Amendment Bills, Finance Minister Alexander Chikwanda said the two Bills sought to provide for fees to be paid directly to the treasury.

Mr Chikwanda said at the moment, the Competition and Consumer Protection Commission (CCPP) and Zambia Environmental Management Agency (ZEMA) retained all the funds they collected for the various services they offer.

“In this regard the treasury does not have full oversight on the collections as required under the Financial Services Act.

“The proposed Bills are intended to enhance accountability in the public management of funds,” Mr Chikwanda said.

Chairperson for the committee on legal affairs, governance, human rights, gender matters and child affairs Jack Mwiimbu, when presenting the report of the committee in the second reading, supported the amendment of the two Bills.

He said the stakeholders supported the amendment of the Competition and Consumer Protection Amendment Bill number 15 of 2013, but called on Government to ensure that funding to the Commission was both timely and adequate.

  1. Who will enforce this piece of legislation, The Police, Government itself or MPs?
    Will this actually work if the enforcing institutions are neither strong nor independent ?
