Two Malawians in court for robbery, murder

 Two Malawian nationals have appeared in the Chipata High Court on two counts of aggravated robbery and murder.The duo, Chancy Mtambalika, 35 , a businessman of Mtamalikamoyo village, chief Mbelwa in Mzimba district, and 35 year old carpenter Thomas Makina of Chikondi Traditional Authority in Zomba district have pleaded not guilty to the two charges.

The two Malawian nationals appeared today before High Court Judge, Dominic Sichinga and are represented by Lawyer Stembridge Chirambo.

Facts before the court were that in the first count, the two accused persons on 15thDecember, 2012 in Lundazi, jointly and whilst armed with a fire arm, stole a Toyota Corolla registration number ALF 7106, valued at KR 27,000-00 from Derrick Simasiku Lungumbwa.

The offence was contrary to the laws of Zambia.

In the second count , the duo on the same day in Lundazi district, jointly and whilst acting together with other unknown persons, murdered Derrick Simasiku Lungumbwa contrary to the laws of Zambia.

But the Defence counsel, Stembridge Chirambo, applied for an adjournment of trial which was supposed to commence today so that he could get instructions from his clients because he only received  the case file yesterday on Monday.

However, in response, the state objected to the application saying that trial should take place because some witnesses that were called to testify in the matter were from Malawi and are  meeting their own expenses since they arrived in Zambia for the case.

Judge Sichinga adjourned the matter to tomorrow, Wednesday, June 5 , 2013 for commencement of trial.
