THE Kabwe High Court has sentenced a 20-year-old man of Mkushi to 10 years imprisonment for causing the death of a nine-year-old girl after defiling her.
Kabwe High court Judge Elita Mwikisa sent Bright Kunda to jail who appeared before her and pleaded guilty to the charge of manslaughter.
Kunda defiled the girl in October 2013 after which she became sick and developed wounds on her genitals and later died.
“You defiled and caused the death of an innocent child who was on her way back from school which is very sad,” Ms Justice Mwikisa said.
Kunda was initially charged with murder but the State applied for amending of the charge to manslaughter.
Facts before the court are that on unknown dates but between October 25 and October 30, 2013, the victim was coming from school when Kunda called her to go to his house.
When the girl reached his house, Kunda grabbed her and defiled.
On October 31, 2013 the girl fell ill and started complaining of pains in her abdomen and back and her aunt took her to the clinic.
The girl was given medication and sent home, but her condition worsened and she could no longer walk.
On November 6, 2013, her aunt decided to take her to Mkushi District Hospital and on the way she narrated her ordeal to her aunt.
Her aunt then checked her private parts and discovered a dilated opening with a white discharge.
The girl later died on the way to the hospital.
In mitigation, Legal Aid Board counsel Humphrey Mweemba said the time Kunda has spent in prison has taught him to be a good citizen.
“Kunda has admitted to the charge without wasting the court’s time and his asking for the court to exercise leniency,” Mr Mweeba said.
Ms Justice Mwikisa told Kunda that she considered his mitigation and will exercise leniency on him and sentenced him to 10 years imprisonment with hard labour.
