Man attacks and robs friend

THE Kitwe Magistrate’s Court has placed a 37-year-old man who allegedly attacked his friend and stole K1,000 cash on his defence after finding him with a case to answer.

 

Appearing before magistrate Kampinda Chipamu was Mark Chishimba of Kitwe’s Chimwemwe township, who is facing one count of theft.
Chishimba, on April 23, 2015 in Kitwe, allegedly stole K1,000 from Isaac Chinyama.

 

During trial, a police officer, George Chisanga, testified that on the material day, he reported for work around 07:00 hours and was allocated a docket of theft against a person.
Mr Chisanga told the court that Chinyama complained that he was attacked and robbed by a person he knew who happened to be his friend.

 

The accused was later apprehended and taken to the police station where he was charged and arrested for the subject offence.
In her ruling delivered last Wednesday, magistrate Chipamu said she was satisfied that the evidence from the prosecution witnesses proved a case against Chishimba.

 

 

“After hearing evidence from the prosecution, I am satisfied that a prima facie case has been established against you, and, therefore, I put you on your defence,” she said.
Chishimba opted to give sworn evidence and told the court that he had no witnesses to call.
The matter was adjourned to July 15, 2015, for defence.
