2 bags of maize land businessman in jail

THE Chingola Magistrate’s Court has sentenced a 56-year-old businessman to three months imprisonment with hard labour for stealing two bags of maize worth K100.

 

Magistrate Lomuti Mtonga convicted Davis Sebeteni of 23 Lulamba Site and Service after he pleaded guilty to theft.
Particulars of the offence are that on June 13 this year in Chingola, Sebeteni did steal two bags of maize, the property of Carol Mwanza.

 

Brief facts before the court were that Ms Mwanza had on the material day gone to visit her farm in Mushishima farming area when she saw the accused stealing maize, which was packed in bags.
She called for help and the accused was apprehended.

 

In mitigation, Sebeteni pleaded for leniency on grounds that he regrets his actions.
Delivering judgment, Mr Mtonga said: “You are an elderly person who should be a role model to children, but you went to steal maize from a woman who is struggling to provide for her family.

 

“I note that you are a first offender and you pleaded guilty without wasting the court’s time, hence you are entitled to leniency. But the offence of theft is too frequent in Chingola. Therefore, I will punish you to deter would-be offenders.”
The convict was given 14 days within which to appeal to the High Court if he was not happy with the court’s verdict.
