Unrepentant ex-convict sent back to jail

Mwense Principle Resident Magistrate Yvonne Nalomba has sentenced a 22-year-old ex-convict of Kashiba chiefdom in the district to four years imprisonment with hard labour for house breaking and theft.

Particulars of count one were that Kelvin Kapya of Shingwe village on
May 7, 2014 broke into Charles Chipili’s shop and stole one amplifier
valued at K400.00 contrary to section 303 subsection (a) of the
penal code chapter 87 of the laws of Zambia.

 

And in count two, Kapya on April 22, 2014 broke into Harrison Sakala’s
house and stole four pairs of jean trousers, three pairs of shoes,
three litres of cooking oil and one gallon of rice.

Other items stolen include two gallons of dry fish, one DSTV decoder,
two curtains, three shirts and four T-shirts all valued at K1000.00.

 

This is contrary to Section 301 subsection (a) and 272 of the penal
code chapter 87 of the laws of Zambia.

Following the accused’s own confession and admission, Principle
Resident Magistrate Nalomba sentenced Kapya to 48 months imprisonment
with hard labour for count one and 48 months with hard labour for
count two and the sentences to run concurrently
