Man sentenced to 3 years for stealing a pig

A NDOLA Magistrate’s Court has sentenced a 23-year-old man of Nkwazi Township to three years imprisonment with hard labour for stealing a pig valued at K1,600 from his former employer.
Magistrate Misozi Banda convicted Shadreck Chibuye of a charge of stock
theft after she received overwhelming evidence against the accused.
Particulars are that on March 8 this year in Ndola, Chibuye stole a pig valued at K1, 600, from Davy Milambo farm.
In mitigation, Chibuye pleaded for lenience as he was remorseful for his actions.
During trial, the court heard that Mr Milambo learnt from his worker that someone had broken into the piggery and stole a pig.
When the complainant and one of his workers went in to inspect the piggery, they found half a pair of slippers. An inquiry in Nkwazi Township, with the half pair of slippers, led them to Chibuye’s house.
When he was apprehended, Chibuye led Mr Milambo to a place within Nkwazi where he had sold the pig and the animal was recovered.
In defence, the accused admitted having stolen the pig because the owner of the farm did not pay him his dues after having worked for him.
“I am convinced beyond any reasonable doubt that the accused is the one who stole the pig as he led police to the recovery of the same.
“The court has also established that the accused was at one time an employee of Mr Milambo and he did not owe him any money, although he claims that he stole the pig because Mr Milambo did not pay him his dues.
“In the circumstances, I find that the prosecution has proved their case against the accused beyond any reasonable doubt. I therefore find the accused guilty as charged and I hereby convict him accordingly. I sentence the accused to three years imprisonment with hard labour with effect from the date he was arrested. T his is, however, subject toconfirmation by the High Court,” Ms Banda said.
