THE Kitwe magistrate’s court has convicted a 50-year-old man of Kitwe’s Kwacha township and committed him to the High Court for sentencing for defiling his eight-year-old stepdaughter on several occasions.
This is in a case in which Jackson Mwape is charged with one count of defilement on a child, which is contrary to Section 138 of the Penal Code Chapter 87 of the Laws of Zambia.
Mwape denied the charge.
It is alleged that Mwape on 30th November  last year, in Kitwe, had unlawful carnal knowledge of a girl under the age of 16.
Magistrate Kampinda Chipamu said she was satisfied that the State managed to prove the case against Mwape and she convicted him accordingly.
Magistrate Chipamu said there was over whelming evidence from the state and that the girl had no reasons to falsely implicate the convict.
“The offence you have been convicted of carries a minimum sentence of 15 years, which is beyond my jurisdiction powers.
“I commit you to the High Court for sentencing and you will present your mitigation there’’ Magistrate Chipamu said.
During trial the girl testified that on the material day around 17:00 hours, her mother and twin sister had gone to the market where she used to sell her commodities.
The girl testified that Mwape, her ‘stepfather’ asked her to take a basin of water to his bedroom.
The court heard that whilst taking the water, Mwape followed the girl to the bedroom where he undressed her and had sex with her.
The girl testified that when her mother came back from the market, she told her what had transpired as she had unbearable pains on her private parts.
The court heard that when the girl’s mother checked her, she discovered there were bruises and blood coming out from the girl’s private parts.
The matter was reported to the police where the convict was arrested and charged with defilement.
