THE Kitwe Magistrate’s Court has sentenced a man of  Kitwe to six months imprisonment with hard labour for assaulting his wife whom he found drinking  alcohol in  a pub with other men.
Senior resident magistrate Daniel Musonda, however, suspended the sentence for 12 months on condition that the convict does not commit a similar offence.
Mr Musonda further ordered Timothy Phiri to pay K500, failure to which he will serve three months simple imprisonment.
This is in a case in which Phiri was charged with and pleaded guilty to assault.
Particulars of the offence are that on September 12, this year, in Kitwe, Phiri allegedly assaulted his wife Sylvia Mfune.
When the matter came up for plea before Mr Musonda, Phiri admitted the charge.
Facts before the court are that on the material day, Mfune went to have a drink at a nearby bar and Phiri trailed her.
Phiri found his wife drinking alcohol with other men and without hesitation or questions, he allegedly slapped and butted her.
The court heard that Mfune escaped and rushed to a nearby police post where she reported the matter.
In mitigation, Phiri said he was sorry and promised never to hit his wife again.
Mr Musonda said he considered Phiri’s mitigation and circumstances under which the assault was committed.
“The assault was as a result of you finding your wife drinking alcohol with other men and in my view; that mitigates your situation. But next time, report her to your in-laws,” Mr Musonda advised.
He observed that very few men desire to find their wives drinking alcohol with other men.
“Notwithstanding, I will sentence you to six months imprisonment with hard labour suspended for 12 months on condition that you do not commit a similar offence,” Mr Musonda said.
