— Two Juveniles plead not guilty against stock theft in Itezhi-tezhi

-Two juveniles of chief Musungwa’s chiefdom in Itezhi Tezhi district in central province are in court on joint charges of alleged stock theft.

 

And  a 24-year-old man of Masasabi resettlement scheme in Itezhi Tezhi district has been sentenced to two years imprisonment for stealing a car battery and inverter.

 

The 17 and 18 -year –old juveniles   both  residing in Shimbulo  village in chief Musungwa’s chiefdom   in Itezhi Tezhi did not contend but readily  pleaded guilty to the offence before Itezhi Tezhi magistrates  Munalula Mubita today.

 

The  grade 7 and 9 juveniles of a named school, who were accompanied by their guardians in court, are charged with one count of stock theft contrary to section 275(1) Cap 87 of the Laws of Zambia.

 

The state alleges that the duo on August 27 this year stole four pigs valued at K2, 800, property of Precious Muzyazhi.

 

Facts of the case are that on 26th August this year, the complainant Muzyazhi, who owns seven pigs secured her animals in a pigpen located few meters from her yard but when she went to the pigpen to feed the animals  the following morning, she found only one pig and four missing.

The court heard that Muzyazhi made frantic efforts to search for her animals in the village and when she found none she reported the matter to Itezhi Tezhi police station who  instituted investigations that culminated into the recovery of the pigs and eventual arrest of the juveniles.

 

When the court asked the juveniles why the stole the pigs, they said they wanted to raise money so that they could go back to school.

 

“We wanted to find money so that we can pay for our school fees. Our parents do not pay for our school fees” one of the accused juvenile told the court.


Itezhi Tezhi magistrates Munalula Mubita then asked their guardians why they do not pay school fees for their children and they responded that they could not afford fees demanded by the schools.

 

State prosecutors told the court the duo had no bonafide right of claim to the four pigs.

 

Itezhi Tezhi magistrate Munalula Mubita said he found the two juveniles guilty as charged upon their own admission and adjourned the matter to 16 September for a report from the Social Welfare Department before sentencing.

 

And  a 24-year-old man of Masasabi resettlement scheme in Itezhi Tezhi district has been sentenced to two years imprisonment for stealing a car battery and inverter.

 

Kennedy Shimbaba who resides in Masasabi resettlement scheme in Itezhi Tezhi district stood charged with one count of theft by servant contrary to section 278 of the Penal Code of the laws of Zambia.

 

Facts of the case are that Shimbaba on unknown dates but between 4th July and 31 October 2013 did stole a car battery and an inverter, the property of Fredrick Mbagweta, 65, a farmer in Masasabi resettlement scheme.

 

Shimbaba who was employed as general worker by Mbagweta and received a regular wage did not contend but readily admitted the charge and   has been convicted as charged and   sentenced to 24 months imprisonment with hard labour.

 

And in the same court a 24-year-old Bar tender of Chibolya A compound in Itezhi Tezhi district central has been sentenced to 18 months imprisonment with hard labour for stealing one bag of cement valued at K80, a property of Build Trust Construction Company.

 

Build trust Construction Company is a firm contracted by Government to construct the D769 road which links Itezhi Tezhi to Mongu Junction road.

 

Before the Itezhi Tezhi magistrates’ court was Clement Mulamfu   who stood charged with one count of simple theft contrary to section of the laws of Zambia.

 

State prosecutors told the court that Mulamfu had no bonafide right of claim to the cement bag and that he had a received a regular wage from Mbagweta.

 

Magistrates Mubita then convicted him upon his admission of the offence and sentenced him to 18 months in imprisonment with hard labour.
