Court throw out teacher unions’ appeal

The Industrial Relations Court has thrown out an appeal by the three Teacher Unions that sought to join a case in which the Professional Teachers Union of Zambia (PROTUZ) has sued government.

The three Teacher unions namely Zambia National Union of Teachers (ZNUT), Basic Education Teachers Union of Zambia (BETUZ) and Secondary Teachers Union of Zambia (SESTUZ) had earlier applied to join the case in which government was taken to court after District Education Board Secretaries (DEBS) of Kabwe, Kitwe, Ndola and Luanshya failed to comply with the labour laws by not processing PROTUZ members’ subscription fees who joined the Union from other teachers union.

Last year, the Court however threw out the application with costs a decision that prompted ZNUT, BETUZ and SESTUZ to appeal against the court’s ruling, which has also been dismissed.

The Court has repeatedly ruled that PROTUZ has the constitutional right to recruit teachers who belong to other unions as long as the teachers themselves make a choice with consent to do so.

And reacting to the Court’s decision, PROTUZ Director for public relations John Mutale has told Qfm News that his union’s objective is to uphold the fundamental rights of workers in accordance with CAP 269 of the Industrial and Labour Relations ACT.
