THE Mporokoso Magistrate’s Court has committed a 46-year-old man of Munwa village in Chief Nsama’s area to the High Court for sentencing after convicting him of sodomising a 14-year-old boy.
Principal resident magistrate Vincent Siloka last Thursday convicted Musonda Sakalani after he pleaded guilty to having sex with a boy against the order of nature.

“The accused is guilty upon his own admission and I convict him accordingly,” Mr Siloka said.
He committed Sakalani to the High Court for sentencing because the minimum statutory sentence for sodomy is 15 years imprisonment with hard labour, which is beyond his jurisdiction.
“You will be remanded in custody until the next sitting of the High Court, where you will make your mitigation and you shall be sentenced from there,” Mr Siloka said.
Particulars of the offence are that Sakalani, on March 31 this year in Mporokoso, had carnal knowledge of a 14-year-old boy against the order of nature.
Facts before the court were that on the fateful day around 14:00 hours, the boy was sent by his mother to collect some cassava from Sakalani.
The court heard that when the boy took long to return home, the mother followed him to Sakalani’s house and heard him crying inside the house.
“She forced her way into the house and found Sakalani having carnal knowledge of her son,” the facts read in part.
The court heard that the woman screamed for help and members of the public apprehended Sakalani and took him to the police station.
The boy was taken to Mporokoso General Hospital, where he was examined and treated.
Sakalani was arrested and charged with the subject offence.
