Kabompo magistrate court grants bail to 16 rioters

 

 

Kabompo, July 9, 2013, ZANIS —–  Sixteen suspects who have been charged with riotous behavior contrary to the law have been granted bail by  the  Kabompo magistrate, today.

 

 

Before magistrate Exad Simusamba was Barnabas Matesu and 15 others who stand charged with unlawful assembly contrary to section 74 and 75 of the penal code CAP 87 of the laws of Zambia.

 

 

 

Magistrate Simusamba granted cash bail of K1, 000 with one working surety to the suspects after Matesu and 15 others pleaded not guilty to the charge.

 

 

 

Assistant senior Legal Aid Counselor Edwin Mazyopa of Solwezi who represented the suspect applied for the bail.  

 

 

 

Matesu is facing a charge with one count of obstruction of council licensing officer of his functions contrary to the local government Act, while the rest of the suspects are charged with unlawful assembly.  

 

 

Facts of the case were that on June 26, 2013 the 15 suspects whilst jointly acting together with others unknown being three or more persons assembled with intent to carry out some common purpose act in a manner to cause fear and others to breach peace.  

 

 

Magistrate Simusamba adjourned the case to July 26, 2013 for commencement of trial.
