Man 27, pleads guilty to stealing a firearm

 

Kapiri Mposhi, June 28, ZANIS – a 27-year-old man of Kapiri Mposhi has pleaded guilty to stealing a firearm and 26 rounds of ammunition on a moving vehicle.

 

And a small scale farmer of Kapiri Mposhi is appearing in the Magistrates court for allegedly forging an official receipt with intent to defraud the Food Reserve Agency (FRA) with over Kr8, 000.

 

Before Magistrate Brenda Chiganda was Kingsley Kanchulubwa of Zambia Compound in Kapiri Mposhi who stood charged with one count of theft from a moving vehicle contrary to section 276 (c) Cap 87 of the laws of Zambia.

 

Kanchulubwa readily admitted the charge as read out to him when the matter came up for plea today.

 

Facts before court are that Kanchulubwa did steal a firearm named pistol with 26 rounds of ammunition on 19 May 2013 property of Mary Simubali of Kitwe.

 

Kanchulubwa snatched the gun after he managed to open the rear door of the moving Toyota Rav 4 vehicle registration number ACD 2351 which Simubali was driving around 19:00 hours near Continental Filling Station along the Great North Road in Kapiri Mposhi.

 

The gun and bullets were later recovered from an unsuspecting member of the public who had bought them at Kr 800.

 

Four men were arrested and remanded in police custody with in connection with the theft of the gun and rounds of ammunition.

 

And magistrate Chiganda has set 3rd July as date for sentencing in the matter.

Magistrate Chiganda adjourned the matter for sentencing after observing that Kanchulubwa was not a first offender.

 

He is still remanded in custody.

 

And a 30-year-old farmer of Kabwale area in Kapiri Mposhi is appearing in court for allegedly altering false documents.

 

Albert Twambo is believed to have forged an official receipt with intent to defraud the Food Reserve Agency (FRA) with over Kr8, 150.

 

Facts before the court were that on 24th August 2012, Twambo supplied the FRA with 30 by 50Kg bags of maize worth Kr1, 950 upon which he was issued the receipt.

 

However, Twambo altered the FRA receipt to read that he instead supplied the agency with 137 by 50kg bags of maize worth Kr8,150 when in fact not which he later issued at Kapiri Mposhi Barclays Bank Branch claiming to be paid.

 

Testifying in the case was Kabwale FRA Satelite depot clerk, Yvonne Mwiinga, PW1, who narrated that she received and weighed 30 by 50Kg bags of maize from Twambo and not 137 by 50kg bags as the accused claimed.

 

Mwiinga said she later referred Twambo to Samuel Sinkala, PW 2, to be issued with an FRA official receipt for the amount of maize he had supplied to the agency.

 

And PW 2, Sammuel Sinkala, a depot inspector at Kabwale satellite depot, also testified that he issued a receipt to Twambo amounting to Kr1, 950 for the 30 by 50Kg bags of maize that he had supplied to the FRA.

 

Sinkala narrated that after it was discovered that Twambo was claiming to be paid for 137 bags of maize worth Kr8,150 he (Sinkala) was called by the Drug Enforcement Commission (DEC) to verify the discrepancies on receipting.

 

He said after the DEC carried out investigations into the matter it was later discovered that Twambo had altered the original FRA receipts issued to him to claim for Kr8, 150 instead of Kr1, 950.

 

And PW3, Stephen Mulenga, a cashier at Barclays Bank said he refused to pay Twambo after noticing that the amount on the receipt was different from that which was on the FRA Schedule for payments to farmers who had supplied their maize.

 

Mulenga said he later referred Twambo back to the FRA to correct the noted anomalies to facilitate his payment.

 

The matter has been adjourned to 10th July 2013 for continued trial while Twambo remains on bail.
