Zimbabwean national charged for unlawful stay in Zambia

—The Livingstone Magistrate court has convicted a Zimbabwean national for over staying in Zambia without documentation.

Magistrate Edsen Shanduba said every person is free to visit other countries but need legal documentation in order to stay in those countries as each country has rules and regulations to be followed.

Before court was Prudence Nkisi 25, of B86 Baton Compound in Livingstone who is a Zimbabwean national married to a Zambian man.

Facts before the court were that the accused entered Zambia through the Victoria falls border in March and applied for a visa as a visitor for thirty days which was granted.

She then applied for another visa on April 4, 2013 for thirty days which was also granted but that after it expired she had since married a Zambian man and decided to stay in the country.

She then travelled to Lusaka this month for a funeral but forgot her passport when she returned to Livingstone.

And as Immigration Officers were conducting inspections it was discovered that she is a Zimbabwean national whose days in the country had expired and had not visited any immigration office to apply for days to stay lawfully in the country.

Ms Nkisi pleaded guilty to the offence of unlawful staying in Zambia which is contrary to section 52 Act 18 of the Immigration Act.

The court found her guilty and fined her 1000 kwacha default of which she will serve a sentence of nine months imprisonment.

In mitigation she apologized and said she would not repeat the offence.
