Kapiri man pleads not guilty to sodomy

——A 73-year old man of Kapiri Mposhi district, accused of sodomizing an eleven-year-old grade three girl, has pleaded not guilty to the charge in the Magistrates’ court.

 

Before Magistrate Brenda Chaganda was Ackson Siwale of house number B 162, Zambia Compound in Kapiri Mposhi, who stood charged with one count of committing unnatural offences contrary to Section 155 (a) of the Penal Code Chapter 87 of the Laws of Zambia as amended by Act number 155.

 

Facts before the court are that on  May 31, 2013 Siwale had sodomised a named minor, a grade three pupil of Palamedis Basic School, against the order of nature after ambushing her at a nearby bush as she walked home from school around 17:00 hours.

 

Siwale, who is unemployed, was arrested on June 7, 2013 after the girl’s mother, Beatrice Nalwamba, reported the matter to police on the same day when the child told her what had happened to her.

 

The child was rushed to hospital where medical tests were conducted on her to determine the report.

 

The medical tests conducted on the child at the hospital proved consistent to the report that she was sodomized.

 

Meanwhile, Magistrate Chiganda has set July 3, 2013 as date for commencement of trial in the matter.

 

The accused remains in police custody.
