Juvenile convicted of defilement

THE Lusaka Magistrate’s court has convicted a 13-year-old boy of Chazanga for sexually abusing a five-year-old girl.
The boy, a grade seven pupil of North Park School was charged with defilement. The offence is contrary to section 138 of the penal code chapter 87 of the laws of Zambia.
It is alleged that the boy had carnal knowledge of the girl three times and promised to give her a KR1.
In mitigation, probation officer Brenda Mafuta said the offence the juvenile committed was serious and serious measures should be taken against him.
Ms Mafuta said the measures should help the boy to change his behaviour and prevent him from inflicting pain and trauma on innocent citizens.
She recommended that both the boy and his victim should undergo counselling to help the boy to repent and his victim to heal emotionally.
Delivering judgement, magistrate Mwaka Mikalile said she would give the boy a non-custodial sentence and uphold the recommendation of the probation officer.
Mrs Mikalile ordered that boy undergoes counselling.
Particulars of the offence are that on unknown dates but between August 1, 2012 and August 24, 2012 in Lusaka, the minor had carnal knowledge of a girl under the age of 16.
